Terms of Use

Beach Watch (“the Service”) is operated by Vero Apps AI Inc. (“we”, “us”), a corporation registered in Ontario, Canada. By using the Service, you agree to these terms. If you do not agree, please do not use the Service.

1. Informational use only

Beach conditions, flag status, surf forecasts, alerts, and any related information provided through Beach Watch are for informational purposes only and may not be accurate, complete, or current. This information must not be relied upon for safety decisions. Beach Watch is not a safety device, a real-time warning system, or a substitute for official safety guidance from lifeguards, local authorities, or government agencies. Conditions may have changed between when an official source updated and when you view the app; sources we rely on may be temporarily unavailable or incorrect; AI parsing may misread a page.

Before entering the water, always check the beach flags physically posted at the beach, observe lifeguard instructions, consult official sources and local authorities, and use your own judgment. Do not rely on Beach Watch as your sole source of safety information.

2. No warranty or guarantee of accuracy

Conditions data is sourced from third-party websites, the National Weather Service, and AI-assisted parsing. We make no guarantee that information is accurate, complete, or current. Conditions at beaches change rapidly and without notice. Do not rely solely on this app to make decisions about water safety.

3. Limitation of liability

To the fullest extent permitted by law, Vero Apps AI Inc., its directors, officers, employees, contractors, and affiliates shall not be liable for any injury, loss, or damage — whether direct, indirect, incidental, consequential, or punitive — arising from your use of, or reliance on, any information provided by this Service. You use this Service entirely at your own risk.

4. Your information & partner sharing

We collect your email address and optionally your phone number to deliver beach condition alerts you have requested.

Beach Watch may share your email address and phone number with trusted marketing partners for relevant offers, promotions, and updates — but only if you have provided separate explicit consent via the “partner consent” checkbox at signup. Some of these partner arrangements involve compensation to Beach Watch — under California law and similar regulations, this constitutes a “sale” of personal information, and we are required to inform you of that.

You may withdraw your partner consent at any time by emailing info@beachwatch.veroapps.ai with the subject “Withdraw partner consent”. You may also request deletion of your account at any time.

5. Notifications

By registering, you consent to receiving beach condition alerts via the channels you select (email, SMS, push notifications). You may update or disable notifications at any time from the Settings screen.

6. Advertising

Beach Watch is a free service supported by display advertising. By using this application, you acknowledge and agree that:

• Display ads are part of the service. Advertisements may be shown within the application at any time. Display advertising cannot be opted out of as it is integral to the free operation of the service.
• Third-party ad networks. Ads are served by third-party advertising networks (such as Google AdSense). These networks may use cookies, device identifiers, and similar technologies to serve relevant advertisements and measure ad performance. Their data practices are governed by their own privacy policies.
• Ad content. Beach Watch does not endorse or control the content of third-party advertisements. We are not responsible for the products, services, or information promoted in ads.
• Partner marketing emails are separate and optional. Partner promotional emails are distinct from display ads and require your separate explicit consent (see Section 4). You may opt out of partner emails at any time — this does not affect display advertising within the app.

7. Service availability

Beach Watch is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or timely operation of the Service. Scheduled maintenance, infrastructure failures, third-party outages (hosting, email, push, SMS, AI providers), or planned downtime may interrupt the Service without notice. We are not liable for any inconvenience, loss, or damage caused by such interruptions, missed alerts, or out-of-date conditions data.

8. Account suspension and termination

You may delete your account at any time from Settings → Delete account, or by contacting us. Deletion is processed as described in our Privacy Policy.

We may suspend, restrict, or terminate your account, with or without notice, if we reasonably believe you have:

• violated these Terms or used the Service for unlawful purposes;
• abused, attacked, or attempted to compromise the Service or other users (including spamming the invite signup, brute-forcing login codes, or attempting to access another user's account);
• provided false or misleading information at signup;
• engaged in conduct that creates legal, financial, or reputational risk for Vero Apps AI Inc.

On termination, the Service ceases for your account and your data is anonymized as described in our Privacy Policy. Sections of these Terms that by their nature should survive termination (limitation of liability, governing law, etc.) continue in force.

9. Children

Beach Watch is not directed at children under 13 (or the applicable minimum digital-consent age in your jurisdiction). We do not knowingly collect data from children. If you believe a child has signed up, contact us at info@beachwatch.veroapps.ai and we will delete the account.

By accepting these Terms, you confirm that you are at least 18 years old, or that you are a parent or legal guardian signing up on behalf of a minor and accept responsibility for their use of the Service.

10. Changes to these terms

We may update these terms from time to time. Continued use of the application after changes are posted constitutes your acceptance of the revised terms. Material changes will be signalled by an updated “Last updated” date at the top of this page; significant changes may also trigger an in-app or email notification.

11. Governing law

These terms are governed by the laws of Ontario, Canada. Any disputes arising from use of this service shall be subject to the exclusive jurisdiction of the courts of Ontario.
